THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.

Our Commitment

Solace Wellness Aesthetics is committed to protecting the privacy of your Protected Health Information (PHI) as required by the Health Insurance Portability and Accountability Act of 1996 (HIPAA) and the Health Information Technology for Economic and Clinical Health Act (HITECH).

How We Use and Disclose Your PHI

Treatment

We use your PHI to provide medical and aesthetic services. This includes sharing information among our licensed providers (Dr. Flávio, nurse practitioner, licensed aestheticians) involved in your care, and with outside healthcare providers when relevant to coordinated care (with your authorization).

Payment

We use your PHI to bill for services and process payments through our payment processors. We do not share medical details beyond what's necessary for billing.

Healthcare Operations

We use your PHI to operate our practice — including quality assurance, staff training, professional review, and business planning. Identifying information is minimized whenever possible.

Other Uses That Require Your Written Authorization

• Marketing communications that use your PHI (we only do this with your written opt-in)
• Sale of your PHI (we do not engage in this practice)
• Use of psychotherapy notes
• Use of photographs for marketing (separate consent required)

Uses Permitted by Law Without Authorization

• Public health activities (disease reporting required by Florida law)
• Reports of suspected abuse, neglect, or domestic violence (mandatory reporting)
• Health oversight activities (audits, investigations)
• Judicial and administrative proceedings (subpoenas, court orders)
• Law enforcement purposes (limited circumstances per HIPAA)
• Workers' compensation claims

Your Rights Under HIPAA

Right to Inspect and Copy

You have the right to inspect and obtain a copy of your medical records. We will respond within 30 days. A reasonable fee for copying may apply.

Right to Amend

You may request that we amend your medical records if you believe they contain incorrect information. Submit requests in writing. We may deny the request in certain circumstances per HIPAA.

Right to an Accounting of Disclosures

You may request a list of disclosures of your PHI made in the past 6 years (excluding disclosures for treatment, payment, healthcare operations, or those you authorized).

Right to Request Restrictions

You may request restrictions on how we use or disclose your PHI. We are not required to agree to all requests, except for restrictions on disclosures to health plans when you pay in full out of pocket.

Right to Confidential Communications

You may request that we communicate with you in a specific way (e.g., only by mail rather than phone) or at a specific location. We will accommodate reasonable requests.

Right to a Paper Copy of This Notice

You may request a paper copy of this notice at any time, even if you've previously received it electronically.

Right to File a Complaint

If you believe your privacy rights have been violated, you may file a complaint with us or with the U.S. Department of Health and Human Services Office for Civil Rights. We will not retaliate against you for filing a complaint.

Our Responsibilities

• Maintain the privacy of your PHI as required by law
• Provide you with this Notice of our duties and privacy practices
• Notify you of any unauthorized access to your PHI (breach notification)
• Follow the terms of this notice currently in effect

Changes to This Notice

We reserve the right to change the terms of this notice and our privacy practices. Any changes will apply to PHI we already have as well as any received in the future. The revised notice will be posted on our website and available at our front desk.
